Whether a dog breeder needs a federal license depends on how many breeding females the operation keeps and how the animals are sold. Under USDA APHIS rules, breeders with four or fewer breeding females who sell only offspring born and raised on site are generally exempt.
When a Dog Breeder Needs a USDA License
Federal licensing for dog breeders turns on two questions, and both must be answered before the requirement applies. The first is how many breeding females the operation maintains. The second is how the animals are sold. Under regulations administered by the USDA’s Animal and Plant Health Inspection Service, a breeder who maintains four or fewer breeding females and sells only offspring born and raised on the premises is generally exempt, and that exemption holds whether sales happen in person or remotely. Above that threshold, the method of sale becomes decisive.
The critical change came in 2013, when APHIS narrowed the definition of a retail pet store. Previously, anyone selling directly to consumers could claim retail status and avoid federal oversight, regardless of how the transaction occurred. The revised rule limits that exemption to sales where the buyer physically observes the animal before purchase. Breeders selling sight-unseen over the internet, by phone or by mail no longer qualify, and must be licensed and inspected if they exceed the four-female threshold. USDA framed the change as a response to an inspector general audit and to the growth of online pet sales.
Two details are frequently misunderstood. The four-female count applies to the household and premises as a whole, so animals cannot be split across family members or business partners to stay under the line. And a USDA licence is not dog-specific: the same Class A and Class B licences cover many species regulated under the Animal Welfare Act, so a licence number alone does not confirm what an operation actually breeds.
